Galway man settles High Court action over shopping centre fall

Galway Bay fm newsroom - A Galway man who claimed he tripped breaking his hip while Christmas shopping at a centre in Dublin has settled High Court action.

The court heard that Michael Harty of Ardour, Kilconly, Tuam had travelled to Blanchardstown Shopping Centre with his wife on December 8th 2012.

The haulier and company director sued Green Property Limited, trading as Blanchardstown Shopping Centre as a result of a the fall which resulted in a hip replacement.

Michael Harty claimed there was a failure to take adequate precautions for the health and safety of pedestrians using the common area of the shopping centre.

It was after the 65-year-old turned to pick up his grandson and the heel of his shoe became stuck in a floor tile.

According to the Irish Examiner, he fell and had immediate pain and was taken to hospital and later had to have a hip replacement.

The company denied the claims and argued that Mr. Harty had stumbled because of his own actions.

The case has been settled and the details of the settlement were not disclosed to the court.
