Galway Bay fm newsroom - A former sales manager with a pet food supplier from Ballinakill in Eyrecourt has settled his High Court action against his ex-employers over allegedly defamatory statements that were published about him.
Last January Gerard Flannery, who had been the Sales Manager in the Republic of Ireland for Northern Ireland based Nutts About Pets Ltd and a related firm Speedritedog Food Limited, secured a temporary injunction against the firms and firm's owner Basil Thompson.
The defendants were ordered to remove certain statements posted on-line about Mr Flannery, which Mr Flannery claimed were defamatory.
The case was adjourned from time to time, with the injunction remaining in place, to allow for out of court talks between the parties.
Mr Flannery's counsel, Margaret Nerney SC told Ms Justice Leonie Reynolds that the case had been settled on terms, and could be struck out.
As part of the settlement, it was agreed that that the terms of the temporary injunction previously granted by the court are to be made permanent.
These include that Nutts About Pets Ltd would remove, delete and not republish posts on the firm's Facebook and the company's website made about Mr Flannery on dates in December 2018.
The defendants were also restrained from publishing any further statements concerning Mr Flannery and his employment with the companies.
In his action, Mr Flannery claimed that on December 7th 2018 he was summarily dismissed without any prior notice. A week later statements were posted on Nutts About Pets Ltd website and Facebook page.
Mr Flannery claimed the statements are an attempt to destroy his reputation.
As a result of the publications Mr Flannery from Ballinakill, Eyrecourt brought proceedings seeking the removal of the posts.
