Galway Bay fm newsroom - The developer of a planned new housing development in Barna is appealing a planning condition imposed by the county council.
Drumque Limited was granted planning permission for 50 new homes at Forramoyle East with 16 planning conditions attached.
However, the company has appealed one of the conditions regarding a restriction on who occupies the new homes.
In an appeal to An Bord Pleanála, Drumque Limited says that a condition which stipulates who can occupy the new houses in Barna in not appropriate for the location.
The condition states that the new occupants must be locals, employed or self-employed, returning emigrants or the immediate family of emigrants or migrants.
The company says it accepts the need for occupancy restriction clauses for residential developments in rural areas.
However it says Barna is a designated settlement centre and therefore the rural housing policy section of the County Development Plan is not applicable.
An Bord Pleanala is due to make a decision in the coming months.
